Case study: Offer changes within the gate closure period

The Electricity Authority Te Mana Hiko works to educate and inform industry participants of their obligations with electricity industry regulations and the Electricity Industry Participation Code 2010 to improve industry practice.

As part of this work, we’ve published a case study on participants’ obligations to meet requirements around offer changes within the gate closure period when offering generation into the wholesale market.

The case study looks at the circumstances of a participant that failed to reduce the megawatt offer in its highest price tranches first, before reducing the megawatt offer in the lower priced tranches. This constituted a breach of clauses 18.18(1), 13.18(1A) and 13.19(1) of the Electricity Industry Participation Code 2010.

The case is a reminder for all participants to ensure they prioritise reducing the megawatt offer in the highest price tranches, before addressing the lower priced ones, when making bona fide revision offers.

Through case studies, we encourage industry participants to learn about common compliance issues, understand lessons learned and how to help improve their own policies and practices.

It is each industry participant’s responsibility to comply with electricity industry regulation, but we are here to support and advise. We publish industry guidelines to clarify participants’ obligations under specific provisions of the Code and welcome any queries to compliance@ea.govt.nz
